These Terms of Use (the "Terms of Use") apply to the iQuestions web site located at www.iQuestions.com, and all associated sites linked to www.iQuestions.com by Unity Corporation, Inc., its subsidiaries and affiliates (collectively, the "Site"). You agree that Unity will not be liable for user submissions or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from this conduct rests entirely with you. The Site is controlled and offered by Unity from its facilities in the United States of America. Unity makes no representations that the Site is appropriate or available for use in other locations. If you access or use the Site from jurisdictions other than the United States of America, you do so at your own volition and are responsible for compliance with local law.

You alone are responsible for the content of the messages you post to the iQuestions Community Kitchen, and any consequences of your messages. Unity does not undertake to monitor or review forums, and the content of these forums is not the responsibility of Unity. Unity reserves the right to terminate your registration if it becomes aware and determines, in its sole discretion, that you are violating any iQuestions Community Kitchen Forum Rules, policies or guidelines. The materials, information and opinions included and/or expressed in or on the iQuestions Community Kitchen Forum are not necessarily those of Unity, its affiliates or content providers. Unity may remove or modify any content without notice or liability at any time in its sole discretion. You agree to the personal jurisdiction by and venue in the state and federal courts in Ada County, Idaho, and waive any objection to such jurisdiction or venue. No recovery may be sought or received for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to costs and attorneys' fees. If you and Unity are unable to resolve any such dispute within a reasonable time (not to exceed thirty days), then either you or Unity may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then you and Unity will be free to pursue any right or remedy available under applicable law.

In the event that any of these Terms of Use conflicts with the law under which the Terms of Use are to be construed or if any such provisions are held invalid by a court with jurisdiction over you and Unity, such provision will be deemed to be restated to reflect as nearly as possible the original intentions of you and Unity in accordance with applicable law, and the remainder of these Terms of Use will remain in full force and effect.

Unity may assign its rights and obligations under these Terms of Use and upon such assignment Unity may be relieved of any further obligation hereunder.

These Terms of Use, including any additional Terms when posted on this Site by Unity, constitute the entire understanding between you and Unity as to the subject matter hereof, and supersede all prior agreements and understandings. Any legally unenforceable provision of these Terms of Use will, at the election of Unity, be deleted or modified to correct the defect and, regardless, the remainder of the Terms of these Terms of Use will remain valid and enforceable.
